Terms of Service
The rules that govern your use of LibertyTalk.

1. Purpose
These Terms of Service (the "Terms") govern access to and use of the LibertyTalk platform, made up of the LibertyTalk web dashboard and the LibertyBroad overlay application (together, the "Service"), operated by LibertyTalk (the "Publisher").
By creating an account or using the Service, you accept these Terms in full. If you use the Service on behalf of an organization, you confirm that you are authorized to bind that organization.
2. Definitions
"User" means any person who accesses the Service. "Account" means the personal access to the Service. "Workspace" means an isolated space containing one or more communities. "Community" means a group managed within a Workspace and its connected networks. "Connected Network" means a third-party service (such as Discord, Twitch, YouTube, Instagram, Facebook or WhatsApp) linked to the Service through its official authorization process.
3. Acceptance of the terms
Acceptance of these Terms is a prerequisite for using the Service. The Publisher may update the Terms; the applicable version is the one in force at the time of use. Continued use after a change constitutes acceptance of the updated Terms.
4. Account and registration
You must provide accurate information when creating your Account and keep it up to date. You are responsible for keeping your credentials confidential and for all activity carried out through your Account.
You must have reached the age of legal majority in your country, or hold the authorization of a legal guardian, to use the Service.
5. Description of the service
The Service lets you connect social and community networks, manage your communities, publish content, automate actions through no-code workflows, run engagement and moderation features, and access a marketplace of widgets and workflows.
The depth of integration varies by network and depends on the permissions granted and on the terms of each third-party network. The Publisher may add, change or remove features to improve the Service.
6. Third-party networks
The Service interacts with third-party networks through their official interfaces and authorization mechanisms. Your use of those networks remains subject to their own terms and policies. The Publisher is not responsible for the availability, the changes or the decisions of third-party networks, including the suspension or limitation of an account on those networks.
You are responsible for holding the rights required to connect an account and to publish the content you distribute through the Service.
7. Subscriptions and billing
The Service is offered through a free plan and paid plans. Paid subscriptions are billed through our payment provider (Stripe), monthly or yearly, and renew automatically unless cancelled before the end of the current period.
Displayed prices are indicative while the offer is being finalized. You can change or cancel your plan at any time from the dashboard; unless required by law, sums already paid for the current period are not refundable.
8. Acceptable use
You agree not to use the Service to publish or distribute unlawful, hateful, harassing, misleading or infringing content, to send unsolicited messages (spam), to circumvent the limits or the security of the Service, or to disrupt its operation.
AI-powered features, such as the Clu copilot and Enhance, rely on your own AI provider API key; you are responsible for your use of that key and for compliance with the corresponding provider's terms.
9. Intellectual property
The Service, its interfaces, trademarks and the content published by the Publisher are protected by intellectual property rights and remain the exclusive property of the Publisher. These Terms grant you a personal, non-exclusive and non-transferable right to use the Service, for the duration of your use and within the limits of these Terms.
10. User content and marketplace
You retain ownership of the content and data you bring to the Service. You grant the Publisher the technical licenses needed to host, process and display that content in order to provide the Service.
Content published on the marketplace (widgets, workflows) remains under the responsibility of its author. Paid sales on the marketplace are processed through the payment provider and may be subject to a commission set out in the applicable conditions.
11. Availability
The Publisher works to keep the Service available but does not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable for maintenance, updates or reasons beyond the Publisher's control, including incidents affecting third-party networks or infrastructure providers.
12. Liability
The Service is provided "as is". To the extent permitted by law, the Publisher cannot be held liable for indirect damages, loss of data, loss of revenue or loss of opportunity arising from the use or the unavailability of the Service, or from decisions taken by third-party networks.
Nothing in these Terms limits liability that cannot be excluded under applicable law.
13. Suspension and termination
You may close your Account at any time. The Publisher may suspend or terminate access to the Service in the event of a breach of these Terms, unlawful use, or a risk to the security of the Service or of other users.
Upon termination, and subject to legal retention obligations, your data may be deleted in accordance with the Privacy Policy.
14. Personal data
The processing of personal data is described in the Privacy Policy, which forms an integral part of these Terms. The Service is designed to be GDPR-compliant, with per-workspace data isolation and per-workspace erasure.
15. Changes to the terms
The Publisher may amend these Terms to reflect changes to the Service or to legal requirements. Significant changes will be communicated by a reasonable means. The date of the last update appears at the top of this document.
16. Governing law
These Terms are governed by the applicable law of the Publisher's place of establishment, without prejudice to the mandatory protections of your country of residence. Any dispute will first be addressed amicably before being brought before the competent courts.
